Resource Management (Past Noncompliance) Amendment Bill

The Parliament of New Zealand enacts as follows:

1. Title
This Act is the Resource Management (Past Noncompliance) Amendment Act 2010.

2. Commencement
This Act comes into force on the day after the date on which it received the Royal Assent.

3. Purpose
The purpose of this Act is to further protect New Zealand's environment by requiring consent authorities to have regard to any record of past non-compliance with resource consents when considering resource consent applications.

4. Principal Act Amended
This Act amends the Resource Management Act 1991.

5. Consent authorities to have regard to past noncompliance
Section 104(1) is amended by inserting the following new paragraph after paragraph (b)

(ba) any history of past noncompliance with this Act by the applicant or any company owned or managed by them; and
