Pardon for Those Convicted of Minor Cannabis Offences Bill

The Parliament of New Zealand enacts as follows:

1. Title
This Act is the Pardon for Those Convicted of Cannabis Offences Act 2022.

2. Commencement
This Act comes into force on the day after the date on which it received the Royal Assent.

3. Purpose
The purpose of this Act is to pardon those convicted of minor drug offences involving cannabis.

4. Act to bind the Crown
This Act binds the Crown.

5. Pardon for Those Convicted of Minor Cannabis Offences

(1) Every person convicted of a specified offence prior to the commencement of this Act is, by this Act, granted a pardon for that offence.

(2) In this section, "specified offence" means:
(a) an offence against s6(1) of the Narcotics Act 1965 or s7(1)(a) of the Misuse of Drugs Act 1975 in relation to cannabis or any cannabis preparation.
(b) an offence against s13(1)(a) of the Misuse of Drugs Act 1975.

(3) For the avoidance of doubt, "specified offence" does not include any offence relating to supply.
