Explanatory Note

This omnibus bill, introduced under standing order 267(b) amends the Official Information Act 1982, and the Local Government Official Information and Meetings Act 1987 to do provide statutory timeframes around decisions refusing to release information in response to information requests where that information will soon be publicly available. The bill provides that agencies may refuse a request on the basis that the information will soon by publicly available if that information will be publicly available within 30 working days of the request being received.

The Parliament of New Zealand enacts as follows:

1. Title
This Act is the Official Information (Refusal of Requests for Information that will soon be Available) Legislation Act 2022.

2. Commencement
This Act comes into force on the day after the date on which it received the Royal Assent.

3. Repeal
This Act is repealed on the day one month after the date on which it entered into force.

4. Principal Acts
This Act amends the Official Information Act 1982 and the Local Government Official Information and Meetings Act 1987.

Amendments to the Official Information Act 1982

5 Section 18 Amended (Refusal of Requests)
Replace section 18(d) with:
"(d) that the information requested is publicly available or will be publicly available within 30 working days of the request being received:"

Amendments to the Local Government Official Information And Meetings Act 1987

6. Amendment to section 17 (Refusal of requests)
Replace section 18(d) with
"(d) that the information requested is publicly available or will be publicly available within 30 working days of the request being received:"
