Holidays (Anzac Day Mondayization) Amendment Bill

The Parliament of New Zealand enacts as follows:

1. Title
This Act is the Holidays (Anzac Day Mondayization) Amendment Act 2009.

2. Commencement
This Act comes into force on the day after the date on which it received the Royal Assent.

3. Principal Act Amended
This Act amends the Holidays Act 2003.

4. New section 45A added
The following section is inserted after section 44:

45A. Transfer of ANZAC Day
(1) For the purposes of this subpart, if ANZAC Day—
(a) falls on a Saturday or Sunday and the day would otherwise be a working day for the employee, the public holiday must be treated as falling on that day:
(b) falls on a Saturday or Sunday and the day would not otherwise be a working day for the employee, the public holiday must be treated as falling on the following Monday unless that day is also a public holiday, in which case it must be treated as falling on the next weekday which is not a public holiday.
(c) falls on a day which is already a public holiday, the public holiday must be treated as falling on the next weekday which is not a public holiday.
(2) To avoid doubt, this section does not entitle an employee to more than one public holidays for ANZAC Day.
