Explanatory Note

Sections 101A and 101B of the Crown Minerals Act 1991 (the "Anadarko Amendment") criminalise protest against the oil industry at sea. They were enacted in 2013 via a supplementary order paper, evading the usual constitutional protection of Bill of Rights Act assessment and select committee scrutiny. Given the attack on protest rights and the unconstitutional process, they were condemned by prominent New Zealanders, including Dame Anne Salmond, former Labour Prime Minister Rt. Hon. Geoffrey Palmer QC, and other lawyers including the late Sir Peter Williams QC.

This bill repeals sections 101A and 101B, restoring New Zealanders protest rights at sea.

Crown Minerals (Repeal Of Anadarko Amendment) Amendment Bill

The Parliament of New Zealand enacts as follows:

1. Title
This Act is the Crown Minerals (Repeal Of Anadarko Amendment) Amendment Act 2018.

2. Commencement
This Act comes into force on the day after the date on which it receives the Royal assent.

3. Principal Act Amended
This Act amends the Crown Minerals Act 1991 (the principal act).

4. Sections 101A and 101B Repealed
Repeal Sections 101A and 101B.
